Terms and Conditions of Sale
Goods and Services that are supplied by MineQuip Automation Pty Ltd T/A MQA Construction Equipment under the following Terms:
A) Title of goods described on a Tax Invoice will NOT pass to the purchaser until payment in full has been received and credited as cleared funds to our account. The purchaser authorizes MineQuip Automation Pty Ltd or our agents to enter upon the property of the purchaser to lawfully repossess any goods not paid in full.
B) Unless otherwise stated on the Tax Invoice all goods are sold in an “As Is Where Is” condition with no warranties implied or given.
C) The purchaser acknowledges that it has inspected all of the equipment before purchase or has waived such right of inspection
D) Unless otherwise stated in writing, the purchaser agrees they have made their own enquiries as to the suitability of the goods purchased and in no way relies on any representations by MineQuip Automation Pty Ltd
E) The payment of a Tax Invoice by the purchaser is an absolute release by the purchaser of the seller from any and all claims which the purchaser has or may hereafter have in respect of the goods purchased (including those resulting from negligent acts or omissions).
F) MineQuip Automation its Employees or Representatives under No Circumstance will NOT be held Liable for any Quarantine or Cleaning or Washing Costs, Extra Transport Costs at all or what so ever.
G) Any Transport Cost Quoted on Invoice is only valid for time and Date quoted, Cleared Funds need to be received to allow machine to be released for pick up/ Dispatch. If Cleared Funds fail to come through in time & machine is unable to be released, additional transport cost may be applicable,
H) Item/s remain property of MineQuip Automation Pty Ltd. until cleared Funds are received in full. No Returns or Refunds once machine has been Dispatched,
I) No Warranty Given or Implied on Machine, -
J) Machine is Sold as Is, With or Without Faults if any at Time of Sale.
K) Parts Supplied, Special orders, Equipment & Attachments Special ordered are not returnable, non-refundable,
L) MineQuip Automation strongly Recommends Purchaser & Owner to organise, acquire & have in place their own appropriate Equipment Insurance & 3rd party Insurance and any registration required for Equipment to Operate, Transport, Travel cover replacement Equipment Costs and Cover the type of work & use of the machine wherever it should operate, Supply Power, Supply Air, Supply Service, dig, Push, excavate, travel and/or Transit.
M) MineQuip Automation is not responsible for any Damage or Loss of machine sustained during Loading, Transport or Un-Loading, Using or Operating,
N) Owner & Operator needs to consult with relevant Authorities before digging such as Dial before you Dig and any Relevant Utilities such as Gas, Telecommunications, Electricity, Water Supply, Sewer, Fire Hydrant, Fibre Optic, Electricity Utilities.
O) Before use of the above Equipment or attachments It is up to the Owner/Operator to ensure machine & its Systems are in a Safe Operating Condition before Every Use
P) MineQuip Automation Advises a Pre- Start Inspection needs to be conducted every day before use, Please refer to OEM (Original Equipment Manufacturer) & Relevant Local, State, National or industry Safety requirements
Q) MineQuip Automation recommends any Daily Maintenance be conducted such as greasing pivot points, checking machine fluid level Checks be conducted before every use or as per OEM Operators Manual
R) It is up to Both the Owner and Operator to Ensure Machine is Safe for Work Site and Each Specific Job, Specific Location Task, That the Owner / Operator Inspect, Identify, Create, Conduct, Form and Obtain & Put in place & Follow An appropriate & Effective Hazard and Risk Management Assessment that Meets All State, Local Government, Federal and Work Area, Job Site and surrounding Area.
S) MineQuip will not be held Responsible or Liable for Any Consequential Loss in any sort , due to Machine Delay, Job Site Modifications or requirements, Breakdown, Hold up what’s so ever.
T) It is up to the Purchaser to ensure his or her Operators are Competent, Qualified & Licensed to Operate the above listed Equipment,
U) MineQuip Automation Pty Ltd or its representative do not imply any attachments or Lifting Tools supplied are Certified & Nor does MineQuip Automation imply any items supplied are within Inspection Date, If Certification or Re- Certifications is required This Service can be provided at an additional Cost, attachments supplied do
V) Operators & Users Must be Read, Understand & Comprehend all Risks & Hazards this Equipment & its attachments, And attain and update any Necessary License, Training and any other requirements to Operate, At all times Operators, Users and People in Work Area Must Wear Correctly all Necessary PPE and Protective Equipment Necessary And follow Owner’s Manual and any additional State, Local and Jobsite OH&S Requirements. It is recommended Owner & Operators should regularly check with manufacture & Dealer for any updated Safety Procedures, Operator manuals and Updated Safety & Service Requirements
